If the company used the photo for any other reason than the implied
one and made a bunch of money from it don't you think that any judge 
in the land would rule for the photographer.
Other than that what is the big deal about a bunch of non photographers 
trying to get their photo in the annual report?
Even a semi advanced amateur photog would know the possible consequences 
of such a contest and make their own judgement as to enter or not.
