The way I understand it is that all telephone communications are  
monitored by the NSA  with several acres of computers somewhere that  
select out likely candidates for human operators. There is also an  
interesting book about the development of effective computer  
encryption that details how NSA has thwarted it, the attitude being  
that you have no right to any communication that they cannot monitor.

I saw Carnivore described as an FBI program that is installed in the  
ISP and that can be activated for any subscriber at any time by the  
FBI and without the knowledge of ISP or subscriber to monitor the  
internet activity and email content of anyone they are interested in.  
The problem is that it bypasses any legal protection that would be  
available to someone who would be wiretapped. That is they do not  
have to go to a judge and prove their need to know in order to listen  
in. The "listening in" in this case would be much less onerous than  
listening to conversations.
