I specifically contacted both eBay and my ISP before doing this. Neither
had a problem with it.
eBay's anti-spam policy apparently forbids generic mass-mailing or selling
addresses, not contacting someone who failed to buy something in order to
help him get a different one.
Of the people I've contacted this way, the vast majority of those who reply
actually thank me for contacting them. Only one person has asked me not to
be contacted. (He was testy, but later chagrined -- he thought I had
ignored an earlier request not to contact him, only to discover that
request to me had bounced.)
