Short answer:
It's lawyer talk, which is not necessarily rational. Yes, what I do is
"commercial" in that I exchange goods for money, but in the art world,
exchanging "art" prints for money, legally speaking, is not legally a
commercial activity, while selling photos to companies to use in advertising
and promotion is.
Don't try to make it make sense. It won't. <g>
