I sort of prefer the composition of this one. However, both are well
composed, depending on the story/mood to be conveyed.
The lack of differentation of siloutte against background is a problem.
That along with the general lack of differentation of tones in the
darker end is a killer for me. Yes, you can see that the silhouette is
separate from the background, but I have to look hard/twice to see it,
and that doesn't work. If there is detail there in scan/image that can
be recovered, this could be quite good.

The overall tonal range/separation is better than the first one, with
the central silhouette better defined.
The way the fellow is leaning way over to the right adds a question to
the image, the answer to which isn't apparent. That weakens it for me by
muddling the story. On the other hand, the placement of the piece of
trash really adds to the story I see.
I would probably crop it a bit on the top, bottom and left side. I would
want the central figure/drama a little bigger and the top and bottom
don't add much. The tree on the left is bright enough to create a second
visual center of attention I would want to get rid of.
I'd also try a tight, vertical crop to see what it looks like. Well, I
did, and I like th change of focus.
For me, both images suffer from the sign. I thnik it's better without.
If you can ignore the artifacts from upsizing a small, compressed file,
you can see what I'm talking about
