Jon,
I have written to the support team about this guy and they say there isn't
anything wrong with what he is doing as long as he has the disclaimer in the
description about sometimes not describing the item accurately and the
bidder should always look at the pictures. (SEE ATTACHMENT)

Samantha,
Thank you so much for your response, although I disagree with it.
The future of Ebay depends upon not only ethical transactions between
sellers and buyers, but also on the "word of mouth" advertising of those who
participate in those transactions and those individuals that carry on
dialogue with the participants.
The gentleman in question, re: this thread, not only titled the auction
inaccurately, but also described the lens in the description paragraph, as a
35mm (f2). He has a picture of the lens (remarkably dark) which is, in my
opinion, an attempt to conceal the true caliber of the lens.
There are those individuals who, mistakenly, -and I agree, naiveté is
rampant here- will purchase this lens and upon receipt, will not only be
highly disappointed but also, will be
highly critical of ebay and all those that participate in its functions.
Those kinds of things are, sometimes, the downfall of an organization. I
think that when there is a clear example of the kind of thing we are talking
about here, the parent organization should be taking steps to correct it. I
am at a loss to see that you are not taking those steps.

Sincerely,
Dick Allen

Hello Dick,

Thank you for writing eBay with your concerns.

eBay doesn't actually handle the merchandise that is offered for
auction. Without firsthand knowledge of the item, we are unable to
guarantee the accuracy of the listing information. We encourage members
who are interested in bidding on an item to email the seller for
additional information. Be sure to ask the seller specific questions
regarding age, authenticity and condition of the item before bidding. In
the unlikely event that the seller doesn't respond, you may want to
reconsider your bidding decision.

Part of this information is contained in our User Agreement, under
article 3. I have included a portion of that Article below for your
review:

"...3.1 Overview. Our site acts as the venue for sellers to list items
(or, as appropriate, solicit offers to buy) and buyers to bid on items.
We are not involved in the actual transaction between buyers and
sellers. As a result, we have no control over the quality, safety or
legality of the items advertised, the truth or accuracy of the listings,
the ability of sellers to sell items or the ability of buyers to buy
items. We cannot ensure that a buyer or seller will actually complete a
transaction..."

Please remember that our Feedback System is available to you to express
satisfaction or displeasure regarding a transaction. This feature is a
very important part of each transaction, as it is a reflection of the
business each member conducts on the site. Comments, whether positive or
negative, will allow others to make educated decisions on whether they
want to deal with a member.

You can access the Feedback System using the URL below:

http://pages.ebay.com/services/forum/feedback.html

You can also quickly access the feedback forum by clicking on the
"services" link at the top of any eBay page, and then by clicking on the
"feedback forum" link also at the top of the page.

Again, thank you for taking the time to write and I appreciate your
continued help in keeping eBay a safe and fair place to trade!

Regards,

Samantha

The lens is posted as a 35mm (F:2). It is a 35mm (F:2.8) A very
signicant difference. Maybe $250.00
difference. The seller also describes it as an F:2
not an F:2.8. The pictures clearly show it as an F:2.8 . This could be
construed as fraud.
