Take out "....., Cary Staynor, ......" from the sentence because it is unclear
whether he is the brother or the suspect..
Who "died" ? ..... the brother did.
Who was "killed"? The "he" is the "suspect" and "he was killed...".
Seems to me that both brothers lost their lives !
